10. Limitation of Liability

Our total liability to you for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Australian Consumer Law

Consumer Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to:

• Cancel your contract with us; and
• Receive a refund for the unused portion, or compensation for its reduced value

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

Unfair Contract Terms

We have drafted these Terms to ensure they are fair and transparent. If any term is found to be unfair under the ACL, that term will not bind you, but the rest of these Terms will continue to apply.

13. Termination

By You

You may terminate your account at any time through your account settings or by contacting support. Termination does not entitle you to refunds for unused subscription periods.

We may terminate or suspend your account immediately for violations of these Terms or for any other reason at our sole discretion with notice.

Effect of Termination

Upon termination, your right to use the Services ceases immediately. We may delete your data after a reasonable retention period unless legally required to retain it.

Dispute Resolution

Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights to any successor or affiliate.

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Services at least 30 days before taking effect. Your continued use after changes constitutes acceptance of the modified Terms.
